Terms and Conditions of business for Giftedgadgets.com

Definitions:
the Business shall mean Giftedgadgets.com
the Customer shall mean an individual purchasing products from the Business

Please note: Items shipped outside of UK mainland are subject to no return, items to be found faulty must be repaired within your country.

We will supply parts free of charge under the warranty period.

  1. We are committed to the protection of all personal details with which we are provided by the customer and which we are required to hold in order to carry out our business, however, we do so securely and lawfully for the customers privacy. We will not pass this information to any third party.
  2. Customers should ensure before placing an order that they have read, understood and accepted the terms and conditions of the Business. An order placed by the Customer constitutes acceptance of the Business' terms and conditions.
  3. The prices displayed within this site are subject to change by the Business without any prior notice. However, once an order has been placed, any price paid by the Customer will not be affected. All prices displayed within the website are inclusive of Value Added Tax (VAT)
  4. The Business will make a nominal charge to the Customer of £3.95 as a contribution by the Customer to the Business towards the cost of delivery within the UK. This charge of £3.95 applies to UK destinations only. Orders over the total of value £50.00 will attract Free Delivery. All orders outside of the UK but within Europe as defined by Royal Mail destinations will have a nominal charge of £7.95 as a contribution by the Customer towards the cost of delivery on all orders no matter what the value.
  5. The Business shall send orders to the Customer using a delivery service deemed appropriate for that item. Our main carriers include Royal Mail and DHL. Any order totaling £50 or more will include a recorded delivery service or signature required service.
  6. In the event that goods sent out to the customer using one of the above services are returned to the business for reasons within the customer?s control, such as no one in to take delivery of goods, then additional delivery charges may apply to cover the cost of re-delivery. If any undelivered orders are then cancelled by the customer any refund will have the delivery charges deducted form the total amount paid.
  7. Once the customer has purchased an order form the site, a confirmation email will be sent to the supplied email address from that customer. This process is an order acknowledgement only, not an acceptance, it simply means that the order will be processed and is not an acceptance by the business of any offers to purchase goods. This email will contain details of the customers purchase from the business and an order reference number.
  8. Order acceptance and completion of purchase takes place when the goods purchased by the customer have been dispatched. An email will be sent from the business to the customer informing them of the impending delivery. Any acknowledgement prior to this delivery email may need to cancel the order for a number of reasons: 1. Product is unavailable from stock because it is damaged or mislabeled. 2. A pricing of product description error.
  9. Risk of damage to or loss of goods shall pass to the Customer once the goods have been dispatched by the Business.
  10. The Business accepts no responsibility once dispatched for the loss or damage to the order once possession of the goods has been passed to the party effecting delivery.
  11. Refunds will only be given if the product can be shown to be faulty and in their original unopened packaging. Refunds are given at the discretion of management. Notification of the fault must be given to the Business within five working days of receipt of delivery.
  12. A reduction of 25% in original value of the larger items such as jukeboxes and associated accesories applies if the item is returned but not faulty. A 25% Re-Stocking Fee applies to all Steepletone products.
  13. If the Customer fails to notify the Business within five working days then the Business is deemed to have correctly performed its obligations in relation to the purchase and sale of the goods
  14. Under Consumer Protection Regulations 2000 (distance selling) the customer has 7 days to notify the business that they wish to cancel their order with the statutory 7 clear working days after receipt of said goods. Notification can be in writing or email (orders@giftedgadgets.co.uk) Good must be returned to the business by the customer at their own expense. Refunds will be issued in not less than 30 days on receipt of the returned goods in a satisfactory condition. The customer is advised to use a recorded delivery service to obtain proof of postage.
  15. Due to the constraints of the Internet, colour may vary from the images displayed in this site. The Business reserves the right to vary colors slightly from the designs shown on this site. However, the Business will where possible endeavor to keep the colors as close as possible to those shown on the site.
  16. In the event of a claim being brought by the Customer against the Business, settlement of such a claim shall be limited to the value of the order/goods purchased if can be proved that these goods were defective by their nature. The Business accepts no responsibility for consequential loss of any nature, whatsoever or howsoever caused.
  17. Payment is only accepted via the method stated in this site. The full balance is payable by the Customer to the Business upon placing an order for the goods, no credit will be given.
  18. Once an order is placed the Business accepts no responsibility for the information given to the Business by the Customer, i.e. delivery address. The Customer must ensure that all places, names etc are spelt correctly.
  19. The Business will aim to complete and dispatch orders within one clear working day timeframe. However the Business reserves the right to dispatch orders earlier or later than stated subject to damaged or faulty stock. The timeframe stated is only an approximate guide and the Business shall not be liable for any delay in delivery howsoever caused. Time for delivery is not of the essence.
  20. Orders are made subject to stock availability. If the Business encounters any problems with the supply of stock, the Customer will be contacted to either change the order to one of a similar nature or alternatively will be given the option of choosing another product. In the event that a compromise cannot be reached between the Business and the Customer, the Customer will be given a full refund.

  22. The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The legislation aims to make producers pay for the collection, treatment and recovery of waste electrical equipment. The regulations also mean that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment free of charge. The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest growing waste stream in the UK. Recycling reduces the environmental and health risks associated with sending electrical goods to landfill.Insert GiftedGadgets.com is obliged under these regulations to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical product. Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol. Goods are marked with this symbol to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste so that they can be recycled.
  23. The validity, construction and performance of this agreement shall be governed by English law.
  24. Any dispute arising between the Business and Customer in connection with or arising out of this agreement shall fall within the jurisdiction of The High Court of England and Wales.
  25. The Business shall not be liable to the customer or be deemed in breach of the agreement by reason of any delay in performing, or any failure to perform any of the Business' obligations in relation to the goods if the delay or failure was due to any cause beyond the Business' reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as causes beyond the Business' reasonable control:
    Act of God, explosion, flood tempest, fire or accident
    1. War or threat of war, sabotage, insurrection, civil disturbance or requisition.
    2. Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of governmental, parliamentary or local authority .
    3. Import or export regulations or embargoes there set.
    4. Strikes or any other industrial actions including trade disputes.
    5. Difficulties in obtaining raw materials, labor, fuel, parts or machinery.
    6. Power failure or breakdown in machinery.
  26. Your statutory rights are not affected by the terms and conditions contained herein
